Welcome to Tiny Store! These Terms of Service ("Terms") govern your access to and use of our website-building platform and related services ("Services"). By using our Services, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our Services.
1. Acceptance of Terms
By accessing or using Tiny Store, you confirm that you have read, understood, and agree to these Terms, as well as our Privacy Policy. If you are using Tiny Store on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms.
2. Eligibility
To use our Services, you must be at least 18 years old or the age of majority in your jurisdiction. By using Tiny Store, you represent and warrant that you meet this requirement.
3. Account Registration
To create your own Tiny Store and access certain features, you must create an account. You are responsible for maintaining the security of your account credentials and all activities under your account. Tiny Store is not liable for any loss or damage resulting from unauthorized account access.
4. Use of Services
You agree to use Tiny Store solely for lawful purposes. You shall not:
- Violate any applicable laws or regulations.
- Infringe on intellectual property rights.
- Distribute malware or harmful content.
- Engage in fraudulent or deceptive activities.
5. Payment and Membership
Certain features or a tier of features may require payment. By becoming a member, you agree to pay the specified fees and any applicable taxes. Payments are non-refundable unless required by law. Tiny Store reserves the right to change pricing and membership terms at any time with notice.
6. Merchant Online Payments
Eligible merchants may connect a Stripe account to accept card payments through Tiny Store. Stripe provides the connected payment account, payment processing, verification, payouts, and Stripe-hosted account tools. Your use of those services is also governed by the agreements you enter into with Stripe.
Fees and payment flow
Customer card payments are processed by Stripe and sent to your connected Stripe account. Merchants on the Teeny plan pay Tiny Store a 3% application fee on each successful online payment. Merchants on the Humongous plan do not pay a Tiny Store transaction fee. Stripe's processing, dispute, currency-conversion, and other applicable fees are separate and may still apply. The fees displayed in payment settings at the time of a transaction control if they differ from this summary.
Merchant responsibilities
You are the seller of record for the products and services offered through your store. You are responsible for product descriptions, pricing, fulfillment, refunds, customer service, taxes, permits, licenses, and compliance with applicable laws. You must monitor your connected Stripe account and respond promptly to verification requests, fraud warnings, disputes, chargebacks, refunds, and customer complaints.
You may not use Tiny Store payments for any business, product, or activity prohibited by law, these Terms, or Stripe's prohibited and restricted businesses rules. Restricted activity may require prior written approval from Stripe and Tiny Store. You must not use payments for fraud, deceptive practices, sanctions evasion, unlawful goods or services, intellectual-property infringement, or activity that creates an unreasonable risk to customers or the payment network.
Refunds, disputes, and negative balances
You authorize Tiny Store to create payment and refund requests through your connected Stripe account when you use those features. You remain responsible for fulfilling valid orders and handling customer refund requests. Stripe decides disputes and may debit funds or fees from your connected account under your Stripe agreement. You must submit dispute evidence through Stripe before the stated deadline. Tiny Store does not guarantee a dispute outcome or recovery of processing fees.
Verification, data sharing, and communications
Tiny Store and Stripe exchange account, business, order, payment, refund, dispute, fraud, and compliance information to provide and protect online payments. Tiny Store may use contact information associated with your account to send required payment, verification, fraud, dispute, and service notices. Submit identity and verification documents only through Stripe-hosted pages; Tiny Store does not ask you to send those documents to Tiny Store support.
Suspension and disconnection
Stripe may restrict charges or payouts when information is missing or risk is detected. Tiny Store may pause online payments, remove listings, or suspend access when reasonably necessary to address prohibited activity, legal or payment-network requirements, fraud, customer harm, unresolved verification requests, or violations of these Terms. Pausing Tiny Store does not resolve outstanding refunds, disputes, fees, or obligations in Stripe.
You may pause online payments in store settings and may disconnect or close the connected Stripe account subject to Stripe's rules. Disconnection does not cancel completed transactions or remove outstanding refunds, disputes, negative balances, fees, recordkeeping duties, or customer obligations.
Tiny Store records the version and time when you accept these Merchant Online Payment Terms. You must accept the current version before connecting Stripe or enabling online payments.
7. Intellectual Property
All content, software, and materials provided by Tiny Store are owned by us or our licensors. You may not copy, modify, or distribute our intellectual property without permission. All content created and maintained by you is owned by you with all rights and responsibilities reserved.
8. Limitation of Liability
To the maximum extent permitted by law, Tiny Store and its affiliates, officers, employees, and agents disclaim all liability for any damages, including but not limited to direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use or inability to use the Services. Tiny Store is provided on an "as is" and "as available" basis without any warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
9. Indemnification
You agree to indemnify and hold harmless Tiny Store, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from your use of the Services or violation of these Terms.
10. Termination
We reserve the right to suspend or terminate your account and access to the Services at any time for any reason, including but not limited to violations of these Terms. You may also terminate your account at any time and assume all responsibilities of your customers related to your Tiny Store. Any fees paid to Tiny Store are non-refundable upon termination.
11. Changes to Terms
We may update these Terms from time to time. We will notify users of significant changes, but it is your responsibility to review the Terms periodically.
12. Governing Law
These Terms are governed by the laws of the United States of America and Canada. Any disputes arising from these Terms shall be resolved in the courts of the relevant State or Province.
13. No Warranty Disclaimer
Tiny Store makes no guarantees regarding the availability, reliability, or accuracy of its Services. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Your use of the Services is at your sole risk.
14. Force Majeure
Tiny Store is not responsible for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, cyberattacks, government actions, or network failures.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.
